File No. 2515/18/2/2014/NHRC Despite sufficient time and opportunity having been given, the requisite Report has not been received. In these circumstances, let summons be issued for the personal appearance of District Magistrate, Bolangir, Odisha before the Commission on 24.9.2015 at 11.00 AM along with the requisite report. In case the report is received on or before 17.9.2015 the personal appearance of District Magistrate, Bolangir, Odisha shall stand dispensed with.

These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 12.07.2015. The essence of the allegation is that three girls, two of class 8th and one of Class 7th of Kasturba Gandlhi Balika Vidyalay Village Kholan under Titilagarh of Bolangir District in the State of Odisha have been subjected to misbehavior/molestation by a male watchman. The said watchman Ratnakar Ghivela was being allowed to sleep inside the girls hostel premises, which allegedly facilitated his malafide activities. Thus the intervention of the Commission has been sought for. Pursuant to the direction of the Commission, a report dated 14.5.2014 from SP Bolangir enclosed therewith an enquiry report by SDPO Titilagarh has been received. In the report the substance of the allegations made in the complaint have been found to have existed against the offender. It has been brought to light that the concerned departmental authorities were well aware about the several incidents of such a nature since 19.11.2013 but it was only confined to departmental proceedings. None of the concerned authorities, nor the parents of the victim girls deemed it just and reasonable to report the matter to the local police. However after a delay of 3 days the complainant Madhu Suna of Village Diaton, Sindhkela reported the matter to the police by then the erring watchman had already absconded. However Titilagarh PS case No 188 dated 22.11.2013 u/s 354-A(ii) /506/34 IPC read with Section 12 of POCSO act 2012 and Section 3(1)(xi) SC/ST Act has been registered. Subsequently, a letter dated 27.9.2014 from SP, Bolangir enclosed therewith a report by SDPO, Titlagarh has been received. It is intimated that a joint enquiry report relating to the incident narrated in the complaint was submitted to the DM, Bolangir on 4.9.2014 vide DR No. 286 dated 4.9.2014 for monetary relief to the victims of the case. According to the report, investigation in the Titlagarh PS case No. 188/13 has been completed and after obtaining caste particulars from the Tehsildar, Titlagarh, charge sheet in the case will be submitted soon. Pursuant to further directions of the Commission, a report dated 21.8.2015 has been received from the Collector and DM, Bolangir, Odisha. It is intimated that each of the victims have been paid statutory financial assistance of Rs. 60,000/- as per S.No. 12.3 (i) (xi) of Resolution No. 21179 dated 28.6.2012 and proof of payment and acknowledgement of its receipt by the victims girls has been enclosed. It is intimated that the night watchman Ratnakar Ghivela and Smt. Suprava Nayak, Warden of the Hostel have already been disengaged from contractual service vide order No. 4198 dated 27.11.2013 and No. 4922 dated 27.11.2013 of DEO-cum-DPC, SSA, Bolangir. It is reported that Shri Biswanath Mishra, I/c of KGBV Hostel, Kholan was changed from the Addl. Charge of Hostel Incharge and Shri Koshor Rana, Asstt. Teacher of Indira Awaas Colony under PS Titlagarh has been given Addl. charge of Hostel I/c of KGBV, Kholan. The Commission has carefully considered the contents of the report and taken note of the statutory payment made to the victims. Since the police and the educational authorities of Bolangir District have taken appropriate action as per law and the case in question i.e. Titilagarh PS case No 188 dated 22.11.13 u/s 354-A(ii) /506/34 IPC read with sec 12 of POCSO act 2012 and sec 3(1)(xi) SC/ST Act is now pending trial, the case needs no further intervention by the Commission. Accordingly, the case may be closed with an intimation to the complainant.
