File No. 2787/18/10/2014/NHRC These proceedings are in continuation of the earlier proceedings of the Commission dated 09.05.14, wherein notice was issued to the concerned authorities calling for a report, within four weeks. A complaint has been received in the Commission from Prabir Kumar Das, Advocate alleging therein that two women, namely, Sumari Gond and Sukuli Gond have died on being electrocuted at Kusumadihipara village under Raighar block of Nawarangpur district of Odisha on 05.05.2014. Sukuli came in contact with the charged wire while the two were on their way to Sabhapara village. 11 KV live wire was lying on a farm land in Kusumadihipara village. When Sumari tried to help her, she too got electrocuted. Both died on the spot. The authorities concerned were not vigilant apparently and they were not aware of the snapped wire though it was their duty to maintain and observe and scrutinize after rain during the summer. They have not been paid any compensation so far and no action has been taken by the concerned Police Station. The Addl. Secretary to Govt., Deptt. of Energy, Odisha has submitted the report dated 06.09.14 stating therein that the matter was enquired into and found that the death of the two women viz. Samari Gond and Sukuli Gond on 05.05.14 happened due to electrical fault as the high voltage wire was lying on the farm land. There was heavy wind with rain on 04.05.14 evening in the area and the 11 KV line was snapped and was lying on the ground. This was due to lack of proper maintenance of lines and sub-stations by the SOUTHCO officials which has led to its unsafe conditions. The Lineman and the Helper of the area for maintenance are also responsible for not remaining vigilant about the condition of the lines during windy and rainy days. JE and Executive Engineer (Electrical), Raighar are responsible for the said incident for not maintaining lines and sub-stations in safe and healthy condition. The Commission examined the report of the Addl. Secretary to Govt., Deptt. of Energy, Odisha. The responsibility has been fixed on the JE and Executive Engineer(Electrical) as well as on Lineman and Helper of the area but action taken report has not been sent so far. Even the report is silent about the payment of compensation to the next of kin of the deceased persons. The said report is also silent whether any FIR was lodged at the Police Station or not. The Addl. Secretary to Govt., Deptt. of Energy, Odisha is directed to submit the report whether any action have been taken against the delinquent officers/officials of the Energy Deptt. alongwith the report of payment of compensation to the next of kin of the deceased persons. The SP of District Khurda, Odisha is directed to submit the report whether any FIR have been registered or not. If yes, its result after investigation and if not, reasons thereof. The DM of District Khurda is directed to submit the report about the payment of ex-gratia to the next of kin of the deceased persons alongwith the proof of payment. Response within six weeks.
On dated 05.05.2014 Somari Ganda , Sukulibai Ganda & P.Ramesh Reddy has died due to the fall of unrepaired 11KV electric wire/line violates Human Rights due to the inaction/unlawful action by the Public Authority.
